LIMITED 15 years WARRANTY 

 

Vertex Stone (the “Product”) that has been permanently installed and is in its originally installed location is warranted by Vertex Stone to be free of manufacturing defects. The Product must be fabricated and installed by an authorized Vertex Stone fabricator or installer and used and maintained in accordance with instructions provided by Vertex Stone in its Maintenance Guide.

 

Although Vertex Stone shall make its best effort to repair or replace with the best possible color match to the original as possible, Vertex Stone cannot guarantee that the repair or replacement will be an exact color match to the original. You must reasonably cooperate with Vertex Stone’s authorized service agents and provide access to the installation site to obtain service under this limited warranty. This warranty is applicable only to the original purchaser and only when all final payments have been made on the product. This warranty is non-transferable. Any associated repair or replacement cost other than the product will be the original purchaser’s responsibility.

 

Terms and Conditions

 

This warranty applies solely to Vertex Stone surfaces and does not apply to any other products including sinks, faucets or any other added appliance, as well as any other engineered stone products, manufactured or supplied by any other party, except by Vertex Stone.

 

This warranty applies to installations of Vertex Stone surfaces that have been permanently installed in the interior of residential and commercial countertop usage, provided they have not been moved from the original, permanent installation.

 

This warranty does not apply to other installations of Vertex Stone including, but not limited to, installations in shower walls and moving vehicles such as, but not limited to, boats or recreational vehicles. Vertex Stone surfaces are for interior use only and this warranty does not cover products installed in any exterior application.

 

What is not covered under this warranty?

 

  • Any residence where the owner is not the occupant.

  • Materials and/or services that have not been paid for in full.

  • Use in any commercial application. Commercial use includes but is not limited to, use in stores, rental properties, offices or any other place of business.

  • Product installed in any outdoors application.

  • Product used as flooring material.

  • Improper use or abuse including but not limited to, damage from mishandling of the product, damage 2 from excessive heat or uneven exposure to weather conditions, physical or chemical abuse and damage from improper care and maintenance.

  • Chips at edges or other areas caused by impact damage.

  • Scratches. Vertex Stone Quartz is highly scratch resistance but is not scratch proof. Proper care must be exercised including the use of a cutting board as part of your care and maintenance

  • Routine maintenance includes but is not limited to, minor conditions such as removing stains and water spots by following the techniques specified in the Vertex Stone Quartz Care & Maintenance Guidelines.

  • Failures due to fabricators/installers not following the prescribed fabrication and installation procedures as outlined by Vertex Stone fabrication and/or installation are the sole responsibility of the fabricator and/or installer. The fabrication and installation procedures include: All corners on the countertop must be rounded to a minimum 3/8” radius. This includes sinks, cooktops, L-shaped counters, window ledges, etc. It is not necessary to round on L-shaped counters where the seams fall at the corners.

  • Defects that were visible at the time of fabrication and were not avoided during fabrication. Fabricators are required to perform a visual inspection of all materials prior to fabrication and again prior to installation.

  • Seam appearance and performance, adhesives, caulk or other accessory items. Once the product is installed, the two main reasons for seam separation or cracking are the shifting or movement of the substrate, cabinets or foundation, and thermal shock. Thermal shock can occur when a hot pan, dish or other receptacle or object is left on the countertop for more than a brief period. Trivets or hot pads should always be used. These issues are not considered material defects and are subject to proper care and maintenance by the owner.

  • Chemical damage.

  • Creative use of the material such as thermal bending or curving.

  • Material that has been reduced in thickness.

  • Securing mechanical fasteners directly into the material.

  • Failures due to inadequate support for the installation.

  • Any other cost incurred including but not limited to painting, plumbing, electrical, tile, cabinets, flooring etc. that may be necessary to modify, remove and or replace in the process rectifying a Vertex Stone Quartz manufacturing defect covered under this warranty.

  • Transportation, freight, tear out, demolition in any form, disposal and re-installation, fabrication or associated cost beyond the cost of the product.

  • Natural variations in the color, size, shape and distribution of the pattern of the natural quartz or the natural variations in background tone. These are inherent characteristics of the product. Color samples provided to consumers, dealers and fabricators are only representative and not an exact replication of what will be installed in your home.

  • Spots or blemishes on mono colors smaller than a U.S. ten (10) cent coin and on multi colored materials smaller than a U.S. Quarter (25) cent coin. A certain level of spots or blemishes are inherent in the manufacturing process and do not affect Vertex Stone’s structural integrity or performance therein.

  • Vertex Stone LLC is not responsible for damage or injury caused in whole or in part by acts of God, job site conditions, and architectural/engineering design, and structural movement, acts of vandalism or accidents.

  • Vertex Stone LLC shall not be responsible in either contract or tort for any loss of direct, indirect, consequential, incidental, special, exemplary, or punitive damages arising out of the use or the inability to use the products covered by this warranty. Some states do not allow exclusion or limitation of incidental damages, so the above limitations or exclusions may not apply to you.

 

THE FOREGOING IS THE COMPLETE WARRANTY FOR VERTEX STONE LLC QUARTZ AND SUPERSEDES ALL OTHER WARRANTIES AND REPRESENTATIONS, WHETHER ORAL OR WRITTEN. EXCEPT AS EXPRESSLY SET FORTH ABOVE, NO OTHER WARRANTIES ARE MADE WITH RESPECT TO VERTEX STONE QUARTZ SURFACING AND VERTEX STONE LLC. EXPRESSLY DISCLAIMS ALL WARRANTIES NOT STATED HEREIN, INCLUDING, TO THE EXTENT PERMITTED BY APPLICABLE LAW, ANY WARRANTY THAT MAY EXIST UNDER NATIONAL, STATE, PROVINCIAL OR LOCAL LAW INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. SOME STATES OR OTHER JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. This warranty gives you specific legal rights, and you may also have other rights that vary from State to State.

 

 

Color Samples:

 

Samples are only for color representation and are not guaranteed to be an exact replica of the final product. Due to the randomness effect of colors that contain movement or veining, some color samples, especially smaller samples, may not capture this overall aesthetic. This does not affect the product performance in any way. Your countertop will not be replaced under this warranty due to color variations from sample(s).

 

Gloss:

Vertex Stone is expected to have slightly less gloss than granite. Gloss levels can be increased by regular cleaning of the surface as directed by the Vertex Stone Care & Maintenance Guide.

 

Excessive Heat:

Thermal damage may occur when a hot pan, pot, dish, or any other receptacle or object is left on the countertop for more than a brief period. Trivets or hot pads should always be used between heated cookware and Vertex Stone surfaces. Damage from excessive heat is considered improper care and maintenance by user, not a material defect, and therefore not covered under this warranty.

 

Chips:

Chips are caused by excessive impact. The quartz and resin are bonded together using vacuum vibro-compression. Chips or any other excessive impact damage are not covered under this warranty.

 

Scratches:

Vertex Stone is extremely scratch resistant. However, scratching can occur when proper care is not used, and accordingly, scratches in your Vertex Stone installation are not covered by this warranty. Cutting boards should always be used between cutlery and Vertex Stone quartz surfaces as part of proper care and maintenance.

 

Staining:

Vertex Stone is stain-resistant, but not stain-proof. Most stains can be removed as outlined in our Care & Maintenance Guide. Stains are not covered by this warranty. You can view our stain cleaning guidelines on our website or in our Care & Maintenance Guide for the best stain removal procedures.

 

 

General Obligations

Vertex Stone is not responsible for damage or injury caused in whole or in part by weather or climate, job site conditions, architectural and engineering design, structural movement or settling, acts of vandalism, or accidents.

 

Vertex Stone’s obligation under this warranty is limited only to the repair or replacement of the Vertex Stone product covered by this warranty, not including necessary labor charges needed to repair, remove or replace the product. Vertex Stone will repair or replace material only of any area of the installation that is determined by Vertex Stone or its warranty service agent to be defective. You will be responsible for any other costs associated with or arising from the repair or replacement. Such repairs include, but are not limited to, repairs to cabinets, backsplash, appliances, wall surfaces, paint, wallpaper, and tiles. Removal of cabinets, storage bins and food garages or backsplashes to allow access to the Vertex Stone product for repair or replacement, as well as costs incurred to enable access to plumbing and electrical connections are not covered under this warranty.

To register your Vertex Stone warranty: go to www.VertexStone.com/warranty and fill out the warranty form. Keep a printed copy of your completed warranty form for your records. Vertex Stone will keep your completed warranty in our warranty database.

 

Claim Procedure

To obtain service under this warranty, contact your original installer or distributor to verify if a warranty claim should be considered. Notify Vertex Stone of the same via email at vertexstone@gmail.com. Include the purported defect(s) prior to the expiration of the warranty period. The customer must furnish to Vertex Stone the original fabricator or installer’s name and current address, and proof of original purchase, purchase date, and location.
